How to Handle Property Damage After a Car Accident in Alabama

After a car crash, your first concern is usually your health — but the next question is almost always:
“How do I get my car fixed — and who’s going to pay for it?”

Step 1: Document Everything at the Scene
If you’re able, take the following steps at the scene of the crash:
- Take photos of the damage to all vehicles involved
- Photograph the scene, including skid marks, debris, and signage
- Get the other driver’s insurance and contact information
- File a police report — this is critical for your claim
Even if you weren’t at fault, insurance companies will want proof, and good documentation goes a long way.
Step 2: Report the Claim to Insurance
You can choose to report the claim:
- To your own insurance company, especially if you have collision coverage
- To the at-fault driver’s insurance company (called a third-party claim)
In Alabama, the at-fault driver is responsible for repairing or replacing your vehicle, but you may need to go through your own policy first to speed up the process — your insurer can then pursue reimbursement through subrogation.
Step 3: Get an Estimate — or Two
Insurance companies will often direct you to one of their preferred repair shops. You have the right to:
- Get your own repair estimate
- Use the repair shop of your choice
If your car is totaled (repair costs exceed market value), you’re entitled to the fair market value of the vehicle — not what you paid or owe on your loan.
Step 4: Ask About Rental Car Coverage
If your vehicle is in the shop or totaled, you may be entitled to a rental car, either through:
- Your own insurance policy (if you have rental reimbursement)
- The at-fault driver’s insurance (but they may not authorize payment until they accept liability)

Step 5: Understand Diminished Value Claims
Even after repairs, your car may be worth less than before the accident. In Alabama, you may be entitled to a diminished value claim, which compensates you for the reduction in resale value due to the crash history.
